From The Highline Report. Starting Nov. 12, 2026, Illinois will treat any consumable or topical hemp product with more than 0.4 milligrams of total THC per container as cannabis. From that day, only dispensaries licensed by the Illinois Department of Financial and Professional Regulation may sell those products.
The change comes from Public Act 104-0463 (SB 3222), which creates the new Illinois Hemp Act. “Total THC” counts delta-9, delta-8, THCa, THC-O, HHC and THC-P, so a product over the line is cannabis whatever its label calls it. Illinois will enforce the rule on Nov. 12 even though the federal per-container limit doesn’t apply until Dec. 11, 2026.
Hemp products under the line, including many CBD products, can stay on regular store shelves, but they now need lab testing, child-resistant packaging and a QR code linking to their certificate of analysis.
What it means at Aces
For adults 21 and over, THC products above the new line will be sold in Illinois only through licensed dispensaries like Aces, where every product is state-tested and tracked. Bring a valid ID showing you’re 21 or older, and ask any budtender if you have questions about a product.
